What a notice to vacate is for

A notice to vacate is not an eviction notice. It is the document that ends a periodic tenancy without cause at the end of the state's notice period. The tenant leaves by the termination date, and the deposit is settled under state law.

The notice period varies with the length of the tenancy and the tenancy type. California landlords give 30 days for tenancies under one year and 60 days for one year or more. New York tiers at 30, 60, and 90 days by tenure length. States without a fixed rule tie the notice to one full rental period.

In just-cause jurisdictions, a no-cause notice is void where the statute applies. California, New Jersey, Oregon, and Washington require the landlord to state a listed cause and document it. Serving a no-cause notice there does nothing and can expose you to a wrongful termination claim.

Do I need a reason to serve a notice to vacate?

In most of the country, no: it is the document that ends a periodic tenancy without cause. The exceptions are just-cause jurisdictions (California, New Jersey, Oregon, Seattle, and others) where you must pick a listed cause and document it; a no-cause notice there is void.

When does the notice clock actually start?

State statutes define service differently: personal delivery starts the clock that day; mail usually adds 3 to 5 days before it counts. Post-and-mail notices start per the statute's definition of effective service. When the deadline matters, serve personally and document it.

Can I withdraw the notice if the tenant pays what they owe?

Yes, in writing, before the termination date. After the date passes without a move-out, the notice has ripened into grounds for eviction, and undoing it takes a new agreement signed by both sides.

If the tenant leaves early, when does the deposit-return clock start?

From the date they actually surrender possession (documented by key return), not from the notice date. They generally owe rent through the notice period unless you re-rent sooner; most states require you to mitigate damages by listing the unit promptly.
